Capital One and Amazon have agreed to pay $190 million for a fund as part of a customer data security litigation settlement to resolve claims that they put customer information at risk in a 2019 data breach, also known as the Capital One Data Breach Class Action Lawsuit.

In July 2019, Capital One announced that they had been the victim of a criminal cyber attack on their systems. The criminals gained unauthorized access to the personal information of approximately 98 million U.S consumers, including names, addresses, zip codes/postal codes, phone numbers, email addresses, dates of birth, self-reported income, credit scores, credit limits, balances, payment history, contact data, and/or fragments of transaction data.

What does the Settlement provide?

Class members can collect cash payments for out-of-pocket expenses and lost time under the terms of this settlement. The settlement allows reimbursement of up to $25,000 and includes money spent preventing identity theft or fraud, unreimbursed fraud charges, miscellaneous expenses, professional fees, and up to 15 hours of lost time at a rate of at least $25 per hour. Class members are required to provide proof such as bank statements, invoices, and receipts.

The settlement offers three years of identity defense services through Pango. These benefits provide dark web monitoring, identity monitoring, lost wallet protection security freeze capabilities, and $1 million in insurance, among other benefits.

Additionally, Capital One also agrees to provide free restoration services through Pango to support class members in the case of fraud or identity theft and has committed to extensive cyber security practices for at least two years.

You could receive reimbursement of up to $25,000 if you spent money dealing with fraud or identity that you believe is connected to the Capital One Data Breach, or to protect yourself from fraud or identity theft as a result of the Breach. You may include your claim for Lost Time.
